Membership agreement and studio policies
Sculpted Hot Pilates is operated by Sculpted LLC, a registered Health Studio with the Florida Department of Agriculture and Consumer Services, Registration No. HS150013. We operate studios in Naples and Estero, Florida. Our primary place of business is 453 Bayfront Place, Naples, FL 34102.
These terms apply to every class, class pack, and membership you buy from us, and to your use of this website. Members also sign a Master Membership Agreement at the point of purchase. Where these terms and that signed agreement differ, the signed agreement governs.
Reserve your spot in advance. Doors open 15 minutes before class, not earlier. Check in on the iPad at the front of the studio when you arrive. Please arrive 10 minutes before class starts. Late arrivals may not be permitted to join once class is underway.
Classes are reserved through Mindbody or the Sculpted app. Cancel at least 12 hours before the class start time so someone else can take the spot. Cancelling inside 12 hours, or not showing up, may be charged a $20 fee, or may forfeit the class credit if you booked with a class pack. The 12 hours runs back from the class start time, not from when you booked.
Repeated late cancellations or no-shows may result in suspension or termination of your membership.
Our studios run between 90 and 95°F using infrared heat. Bring water and drink before, during, and after class. There are water fountains in the studio so you can refill. If you feel dizzy, nauseous, or overheated, stop, rest, or step outside for air. Nobody will think anything of it.
Tell your instructor before class about any injuries or health conditions, and if it is your first infrared-heated class. Every movement can be adapted.
A mat, a water bottle, and a towel for your mat. Studio mats rent for $5, just ask your instructor. Leave shoes at the front.
All exercise equipment is provided: elastic bands, blocks, balls, hand weights, and ankle weights. You are welcome to bring your own cloth resistance bands. Your instructor will tell you what to use in each class.
We maintain an inclusive, judgment-free environment. All levels, all bodies, all backgrounds are welcome. Disrespectful behavior of any kind will not be tolerated.
Set up within your designated space so everyone has room to move. No vaping or smoking anywhere on the premises, including the lobby, restrooms, and surrounding areas.
The studio is monitored by video surveillance for the safety and security of members and staff. Cameras are not present in changing areas or restrooms.
We reserve the right to suspend or terminate a membership at any time for violation of studio rules, including disruptive behavior, harassment, unsafe conduct, non-payment or chargebacks, or disrespect toward staff or members. Termination for a rule violation does not waive any balance still owed.
Everyone signs a liability waiver before their first class. For most clients this happens when you create an account and book, either in Mindbody or through a third-party booking partner, so there is no separate step.
Guests must be at least 12 years old to take class. Anyone under 18 must have a waiver completed by a parent or legal guardian before participating. The waiver you sign when booking does not cover a minor. The guardian waiver can be completed online before arrival or in person at the studio.
Sign the Minor WaiverBy entering the studio you consent to being photographed or filmed, and to those images or that footage appearing on our social media channels and website. If you would rather not appear, tell a staff member before class begins and we will make every effort to keep you out of anything we share.
We encourage you to film yourself and share it. Please be mindful of the people around you and do not film other members without their consent.
Public livestreaming during class is not permitted. Recording and posting afterwards is welcome and encouraged. Broadcasting live to a public audience (Instagram Live, TikTok Live, YouTube Live, or any similar stream) is not permitted while class is running. Private video calls are fine.
All purchases are made through Mindbody, either on this website's links or in the Sculpted app. This website does not process payments. Prices are the same at every Sculpted studio and may change at any time.
Some reservations may also be made through third-party booking partners, who have their own terms and their own cancellation rules.
Single classes and class packs expire 12 months from the purchase date. Unused classes are forfeited at expiry.
All sales are final. No refunds, returns, or transfers.
Memberships require a minimum 12-month initial commitment. We auto-bill the payment method on file every 30 days. After the initial 12-month term, the membership continues on a month-to-month basis until cancelled.
Initial contracts are limited to a maximum of 36 months. Renewal contracts may not be executed until 60 days or less before the previous contract expires, and may be renewed annually only.
No membership freezes or pauses are available. Billing continues every 30 days for the full initial term, except as required by Florida law.
After the three-day cancellation period described below, a membership may be cancelled without penalty only in these circumstances:
Refunds in these cases are calculated by dividing the contract price by the number of weeks in the term and multiplying by the weeks remaining, and are issued within 30 days of us receiving your notice and documentation.
For any other reason, cancelling before the end of the initial 12-month term requires payment of the remaining balance. After the initial term, month-to-month memberships may be cancelled with 30 days' written notice.
All cancellation requests must be in writing and delivered either in person at the studio or by U.S. mail to the address above. Phone calls, texts, emails, and social media messages are not accepted as formal cancellation notice.
Memberships may not be transferred, shared, or sold. Only the account holder may use a membership.
You must keep a valid payment method on file at all times. Failed or declined payments may incur a $15 fee, and access is suspended until billing is resolved. No membership constitutes prepayment of more than 30 days of dues.
Classes take place in an infrared-heated environment and involve intense physical activity. By participating you voluntarily assume the risks involved and release Sculpted Hot Pilates, its owners, employees, and instructors from liability to the fullest extent permitted by Florida law. Nothing here waives any right granted to you under Florida's Health Studio Act, sections 501.012 to 501.019, Florida Statutes.
We are not medical providers. Consult a physician before beginning any exercise program, particularly one in an infrared-heated room. Infrared-heated classes are not recommended during pregnancy.
Sculpted LLC is registered with the Florida Department of Agriculture and Consumer Services as a Health Studio, Registration No. HS150013.
Your statutory rights, including the three-day right to cancel, cancellation on closure or relocation, cancellation for death or disability, how refunds are computed, and limits on contract term and renewal, are set out in full in the Master Membership Agreement you sign, in boldface, immediately above your signature, as Florida law requires.
If we go out of business, you may contact the Florida Department of Agriculture and Consumer Services within 60 days at 1-800-435-7352 or FDACS.gov.
Sculpted does not require members to show identification to enter the studio as a condition of using our services.

We may update these terms. The last updated date at the top will change when we do, and material changes affecting existing members will be communicated directly.
These terms are governed by Florida law and are subject to Florida's Health Studio Act. Any provision that conflicts with Florida law is void to the extent of the conflict; the rest stands.
